Terms & Agreements

By making a reservation at Apogeo Guest House, I (acting as “the guest” who is booking the reservation) consent that I have read and agreed to the policies on this page and will send a payment via Paypal to complete my reservation. If I do not do that, I authorize Apogeo Guest House to charge my credit card for the total reservation amount, plus any applicable credit card processing fees and/or PayPal fees. I also authorize Apogeo Guest House to charge my credit card, plus any applicable credit card processing fees and/or PayPal fees, for all charges I (and the guests in my reserved party) incur while on the Apogeo Guest House property. I affirm that I have received and read the Terms & Agreements listed below and understand that this serves as a legally binding agreement and the equivalent of a written contract.

CANCELLATION POLICY:
This agreement is between “the guest” whose name is listed during the booking process as “Guest Name” and Apogeo Guest House (a property managed by Apogeo Collective, Sara Elise, and Amber Drew). A credit card is required as a guarantee for the total amount of the reservation regardless of your final payment choice. For reservations made prior to 4 weeks before the guest’s reservation start/arrival date, a deposit to hold the reservation is required on the date of booking the reservation at 50% of the total amount of the reservation. For reservations made less than 4 weeks before the guest’s reservation start/arrival date, a deposit to hold the reservation is required on the date of booking the reservation at 100% of the total amount of the reservation. Once your payment is received and the reservation is confirmed, you have up to 5 days to cancel your reservation for a full refund (minus a nonrefundable $25 USD processing fee and any applicable PayPal fees). After 5 days, the booking deposit is 100% non-refundable regardless of whether or not you cancel your reservation or show up for your reservation. The balance of the total rate of the reservation is due 30 days prior to the first date of the booking reservation. If the reservation is cancelled 30 days or less prior to the arrival date, 100% of the “Total Balance Due” will be charged to the card on file listed above. Any modifications to shorten your reservation must be received at least 30 days prior to your arrival date. If received less than 30 days prior to arrival, you agree to pay the full amount originally requested and reserved. If the reservation is cancelled over 31 days prior to the arrival date via email to Hello@ApogeoCollective.com, only 50% of the balance due will be charged.

TRANSFER POLICY:
At any time, your reserved stay is fully transferable to another guest party. Just email us at Hello@ApogeoCollective.com with your confirmation and the information for the new guest and we will transfer the reservation to them.

If you cannot make your Active Season reservation and would like to transfer it to a different date within the same Active Season that your current reservation is booked in, Apogeo Guest House will do their best to accommodate a date transfer (pending availability of your newly requested dates). If they cannot accommodate, then your reservation is nonrefundable and not transferrable to another date in another Active Season. Your stay might be transferable to another date in an Open Season, pending availability of your newly requested dates. If new dates cannot be agreed upon by both parties (Apogeo Guest House and “the guest”) then your reservation is nonrefundable and not transferrable to another date. There are no exceptions to this policy. However, at any time, your reserved stay is fully transferable to another guest party. Just email us at Hello@ApogeoCollective.com with your confirmation and the information for the new guest and we will transfer the reservation to them.

GUEST BILL / ROOM BILL:
When using PayPal to pay for your stay at Apogeo Guest House (or paying for your onsite room bill), please select your transfer as a transfer to “friends and family” to avoid any PayPal service fees. Upon checkout at Apogeo Guest House, any charges incurred while at Apogeo Guest House will be charged to the card on file if not settled prior to checkout while onsite. You will be provided with an emailed invoice for all charges incurred and it is the guest’s responsibility to pay the balance in full via credit card, PayPal, or Zelle, including any applicable late fees, PayPal fees, bank fees, etc. incurred.

OTHER INFORMATION:
The Apogeo experience is available for all people who identify as being part of at least one of the following communities: people of color, LGBTQIA+, gender non-conforming people, an active ally to any of these communities. By signing this form, you agree that you are part of at least one of these communities.

This is a child-free space for gathering, so no young people under 18+ are permitted in the space aside from youth-specific retreats or Full House reservations (Open Season only).

Animals (other than service animals) are not permitted on the property.

Check in at Apogeo Guest House is at 3PM on your reserved check-in date and check-out is by 11AM on your reserved check-out date. If you stay past 11AM without checking in with us and receiving late check-out approval, we will charge a $100 late check-out fee to the card on file.

We are doing our best to work within the infrastructure of the place we are in. Please note that there might be electrical power outages, WiFi outages, hot water outages, and shower/sink water outages at different times. Please know that we are doing our best to resolve every issue. Apogeo Guest House is not responsible and should not be held liable for any infrastructural issues (including and in addition to the ones listed above) that are outside of the scope of our control.

CONSENT FOR CONTACT:
Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew may collect personally identifiable information when guests, such as you, voluntarily submit such information to Apogeo Guest House and/or Apogeo Collective.  “Personally identifiable information” includes, but is not limited to, your name, any of your e-mail addresses, any mailing addresses, any phone numbers, and information regarding any event for which Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew are engaged.  You grant Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew the right to disclose your personally identifiable information for customer service purposes, marketing purposes and as needed to comply with legal requirements, including court orders, judicial proceedings, subpoenas, or matters of public safety.  You grant Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew the right to photograph and/or video your stay at Apogeo Guest House and activities related to such reservation both on and off the property and post such photographs and/or videos on any social media or digital platform and to otherwise use such photographs and/or videos in any marketing efforts. By providing the phone number(s) and email addresses above, you expressly consent to receiving calls and text messages and emails from Apogeo Guest House and/or Apogeo Collective, including informational, emergency, marketing, and promotional calls or text messages, at the emails and phone number(s) provided. You further agree and acknowledge that (a) your consent to receive calls and emails and text messages is not required to receive product or services from Apogeo Guest House and/or Apogeo Collective and (b) that you are the current owner or subscriber of the phone number(s) provided below and, unless you contact Apogeo Guest House and/or Apogeo Collective and inform Apogeo Guest House and/or Apogeo Collective of a change in contact information, you have the authority to consent to receive emails and calls and text messages at the phone number(s) provided.

LIABILITY WAIVER:
Apogeo Guest House (a property of Apogeo Collective) nor Sara Elise nor Amber Drew are responsible for any loss incurred at the property or in any of the units— so it is advisable that you take proper care of all belongings and valuable items.  Apogeo Collective nor Sara Elise nor Amber Drew are responsible for an injuries or illness incurred at the property or in any of the units. Apogeo Collective, Sara Elise, and Amber Drew’s liability for breach of this Agreement shall be limited to the return of any sums actually paid to Apogeo Collective, Sara Elise, and/or Amber Drew. You agree to irrevocably, fully and unconditionally defend, indemnify and hold harmless Apogeo Collective, Sara Elise, and Amber Drew, its owners, employees, independent contractors, staff, heirs, successors or assigns from liability, claims, demands, actions and causes of action arising out of or related to any loss, damages, illness, death or injury to invitees, licensees and other guests sustained during your event in connection with the services provided by Apogeo Guest House (and/or Apogeo Collective), Sara Elise, and Amber Drew, its owners, employees, independent contractors, staff, heirs, or successors during, before, or after your stay at Apogeo Guest House. You shall be responsible for all costs of litigation incurred by Sara Elise, Amber Drew, and Apogeo Guest House (and/or) Apogeo Collective in enforcing this Agreement, which costs may include court costs, all costs of litigation and reasonable attorneys’ fees .

Apogeo Guest House is not responsible and should not be held liable for any infrastructural issues (including and in addition to the ones listed above) that are outside of the scope of our control.

Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew shall not be held liable or responsible to you, nor be deemed to have defaulted under or breached any agreement with you, for any for any failure or delay in fulfilling or performing any of its obligations to you to the extent such failure or delay is caused by or results from acts beyond Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew’s reasonable control, including, but not limited to, the following force majeure events (each, a “Force Majeure Event”): (a) acts of God; (b) flood, fire, earthquake or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) action by any governmental authority; (f) national or regional emergency; (g) strikes, labor stoppages or slowdowns or other industrial disturbances; or (h) shortage of adequate power or transportation facilities (including highway obstructions, impassable roadways, or breakdowns or mechanical defects of vehicles or equipment).  Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew shall resume the performance of its obligations to you as soon as reasonably practicable after the removal of the Force Majeure Event.  In the event Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew determine that it will be unable to fulfill its obligations to you as a result of a Force Majeure Event, Apogeo Guest House and/or Apogeo Collective, Sara Elise, or Amber Drew shall notify you and shall refund any deposit minus any reasonable expenses incurred by Apogeo Guest House and/or Apogeo Collective, Sara Elise, or Amber Drew to prepare for your event and to compensate Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew for other lost business opportunities incurred in preparation for your stay.  Apogeo Guest House and/or Apogeo Collective, Sara Elise, and Amber Drew shall not be held liable to you for any damages incurred by you, whether actual or consequential, which may result from Apogeo Guest House and/or Apogeo Collective, Sara Elise, and/or Amber Drew’s non-performance due to a Force Majeure Event

The above cardholder, and all members of their party, hereby agrees that all claims &/or disputes whatsoever arising under, in connection with or incident to this reservation &/or the guest’s stay at Apogeo Guest House shall be subject to the laws of & litigated in & before the courts of the Republic of Nicaragua to the exclusion of the courts of any other jurisdiction. Guest hereby consents to jurisdiction, for himself & his party, & waives any venue or other objection that he may have to any such proceeding being brought in the applicable court(s) of Nicaragua.
